Discharge for man who grew cannabis to help his epilepsy (UK)

A MAN grew his own cannabis because he smoked the drug to tackle his epilepsy, a court heard.

Paul McGlinchey was caught with two plants at his home, city magistrates heard.

The 39-year-old, of Taunton Avenue, Whitleigh, yesterday admitted producing the Class B drug on March 26.

Gareth Warden, for the Crown Prosecution Service, said police acting on a tip-off called at his house. He said officers could smell cannabis and found a tent containing two mature plants, together with cabling, a light and a fan.

Mr Warden said there was no evidence the plants were being grown for commercial supply.

Ken Papenfus, for McGlinchey, said he suffered from epilepsy but had used cannabis to cope.

Mr Papenfus added cannabis helped him manage seizures. He said McGlinchey grew the drug to avoid mixing with the "criminal fraternity" and buying from the street.

But Mr Papenfus said he had since seen the "error of his ways" and was using a prescribed drug instead.

Magistrates gave him a 12-month conditional discharge.
