legally if you grow maximum 5 plants in or outdoor shouldn't make any difference aslong as you pay the electricity and have a professionally set up growroom with NOT more than 5 plants. ofcourse you'd have to grow them only for personel use. i've set up a indoor growroom 1m by 1.20m big enough for 5 but ill start with three because if you lead your plants you dont need more to fill the space. and get as much off it as you normally get from five. aproxx. 400/500 gr per sq.m only have to install everything and then i'm starting my indoor project. i'm not afraid off cops coming by, iff they want to let them come. i'm not afraid off goíng to the court, somebody has to make an example. and start the road to total legalisation.

Legale thuisteelt en enkele kilo’s cannabis In deze column ga ik in op een onderwerp dat verbazingwekkend weinig bekendheid geniet. Het gaat om de bij wet toegestane thuisteelt voor eigen gebruik van maximaal vijf cannabisplanten en het feit dat deze vijf planten een oogst kunnen opleveren van enkele onsjes tot zelfs kilo’s. Deze hoeveelheid wordt bij elke groeicyclus op volstrekt legale wijze geoogst, als we mogen afgaan op de duidelijke regel van het gedoogbeleid dat iedereen vijf planten voor eigen gebruik mag kweken. De regels van het gedoogbeleid, gebaseerd op de Opiumwet, luiden dat als de politie de thuiskweker betrapt en hij afstand doet van de planten, hij niet wordt vervolgd voor het bezit van de vijf cannabisplanten en de zaak wordt geseponeerd. De vraag rijst hoe dit zich verhoudt tot de regel dat elke burger niet meer dan vijf gram cannabis in zijn bezit mag hebben. In het zuiden des lands vond enkele jaren geleden een inval plaats in een woonwagenkamp. De politie trof enkele net geoogste weedplanten aan en her en der enkele vuilniszakken met droge en natte toppen. In totaal ging het om bijna zeven kilo toppen en plantenresten. Het openbaar ministerie rook lont en vervolgde de kampbewoners Het gerechtshof te Den Bosch moest een oordeel vellen over de verhouding tussen twee regels die niet met elkaar te verenigen zijn. De eerste regel – die ik al noemde – is dat niemand meer dan vijf gram cannabis in bezit mag hebben voor eigen gebruik. De tweede regel echter geeft de burger het recht om maximaal vijf cannabisplanten te kweken voor eigen gebruik. Natuurlijk klopt hier iets niet. Elke oogstrijpe cannabisplant van goede origine bevat een hoeveelheid toppen die de vijf gramsnorm royaal overschrijdt. Hoe nu om te gaan met die schizofrene regelgeving? Dat was de vraag die het gerechtshof van Den Bosch moest beantwoorden. De rechter moest een oordeel vellen over de vraag of de in het woonwagenkamp aangetroffen hoeveelheden toppen en plantenresten met een totaalgewicht van ruim 6,5 kilo een overtreding van de Opiumwet opleverde die op grond van het gedoogbeleid kon worden vervolgd. Je zou denken dat een veroordeling voor meerdere kilo’s in de rede ligt, maar schijn bedriegt. De verdediging van de kampbewoners stelde dat de aangetroffen cannabis afkomstig was van de zojuist geoogste vijf planten en dat er daarom geen sprake kon zijn van een strafbaar feit. Sommige weedtoppen waren nat, andere lagen te drogen. Verder werd een aantal cannabisstruiken aangetroffen waarvan werd verondersteld dat deze kort tevoren was geoogst. Deze struiken leverden samen met de natte en droge toppen een gewicht op van bijna zeven kilo. De wetgever heeft zich namelijk in het geheel niet bekommerd over het feit dat vijf volgroeide planten vanzelfsprekend een oogst aan welriekende toppen oplevert die de wettelijk voorgeschreven vijf gram voor eigen gebruik ver te boven gaat. De wetgever hanteert uitsluitend de limiet van vijf cannabisplanten en legt verder helemaal niets uit over de door deze planten gegenereerde totale opbrengst. Kortom, de kampbewoners hadden helemaal niets fout gedaan, zo redeneerde de verdediging. Het Bossche hof ging met die redenering mee. De wetgever heeft duidelijk afgesproken dat een burger niet wordt vervolgd bij het bezit van vijf planten. Een burger wordt pas gebonden aan voorschriften als deze duidelijk zijn en vooraf kenbaar zijn gemaakt door publicatie. De regel dat iemand voor eigen gebruik niet meer dan vijf gram cannabis mag bezitten komt ietwat verwarrend over als dezelfde persoon zonder enig voorbehoud maximaal vijf planten mag kweken om in zijn eigen consumptie te voorzien. Daar heeft de wetgever geen duidelijkheid over verschaft. Van onduidelijke regels mag de burger niet de dupe worden, zo oordeelde het gerechtshof. De burger mag erop vertrouwen niet te worden vervolgd voor de hoeveelheid cannabis die vijf planten opleveren. En dus verklaarde de rechter het openbaar ministerie niet ontvankelijk omdat het in strijd met zijn eigen regels tot vervolging was overgegaan. Deze historische uitspraak heeft tot gevolg dat iedereen in Nederland met een groeikas met vijf planten en een daarbij behorende oogst van enkele onsjes tot kilo’s in de geest van de wet handelt en dus niet strafbaar is. Dat kan bijzonder aantrekkelijk zijn als je de juiste soorten met bijbehorende opbrengsten kweekt. Het moet wel gaan om eigen gebruik. Als je de politie vertelt dat je van plan was de opbrengst te verkopen vervalt de strikte voorwaarde om niet te worden vervolgd en kan je er gevoeglijk vanuit gaan dat ook de kweekkas in beslag wordt genomen en je een dagvaarding of een transactievoorstel ontvangt. Uitgangspunt voor het gedoogbeleid blijft immers dat je je volledig aan de afspraken houdt om niet te worden vervolgd. Als je de strikte voorwaarden zelfs maar even overtreedt zal de officier van justitie je met het gebruikelijke strafrechtelijke instrumentarium tegemoet treden. Veldman, M (2012, 19 juni). today they said on the news that a few hundred people workin at a dutch coffeshop are getting fired, because the owner cant pay them because some coffeeshops only have 14 members. not enough to pay the bill's. but now the government has fallen we get new elections, so maybe after september everything's going to be normal again. i hope.

strange but true, believe it or not but from tomorrow may 1st i'm not allowed to buy any more weed from the local coffeeshop (bonnneville) because i don't want to registrate there as a member. if i want to i have to go to the mayors office and get a paper that states i live where i live and copy that for them, and i have to make a copy of my i.d. then every socalled member has to pay 5 euro administration fee, before you're alllowed to buy weed there. they have a maximum off 2000 members ,2000 times 5 is 10.000 euro. i call that A RIP OFF !! do they make so little money that they have to charge everyone who wants to be a part of their socalled (family). its the only shop in town, they have plans for another one but only god knows when it will open. there is money because there are going to be more cops to see that there are no illegal sales. better use the money for a god cause instead of wasting it chasing innocent blowers/pot dealers. it's just another good reason for growing your own medicine, so you know what you smoke, dont pay too much,and selfsufficient. and if you grow too much don't worry do as i do give it away, your friends will love you for it!!!!
